Car Rental – Individual Customers

MEHARIVIERA

These General Terms and Conditions of Sale govern the vehicle rentals offered by SARL MEHARIVIERA

intended for individual customers, for tourism, leisure, or private events.

By making a reservation, you fully and unconditionally agree to these Terms and Conditions of Sale.

Article 1 – Purpose

The purpose of these Terms and Conditions is to define the terms under which MEHARIVIERA provides

vehicles to individual customers for tourism, leisure, or private events.

Article 2 – Reservation and Payment

Full payment is due at the time of booking.

The reservation becomes final and binding after:

• full payment for the service

• Acceptance of these Terms and Conditions

No vehicle will be released without prior full payment.

MEHARIVIERA reserves the right to cancel a reservation in the event of non-payment.

Article 3 – Cancellation Policy

Unless otherwise stated in the quote or booking confirmation:

More than 30 days before the service: 100% refund

Between 30 and 15 days before the service: 50% refund

Less than 15 days before the service: no refund

All cancellations must be made in writing.

No exceptions will be granted except in cases of duly substantiated force majeure.

Article 4 – Authorized Drivers

Drivers must comply with the following requirements:

Minimum age: 21

A driver's license that has been valid for at least one year

Authorized drivers are strictly limited to the individuals listed at the time of booking.

Foreign drivers may be required to have an international driver's license

in accordance with the regulations.

MEHARIVIERA reserves the right to refuse to provide a vehicle in the event of

invalid license or doubts about the driver's ability to drive.

Article 5 – Security Deposit

A security deposit of €1,000 per vehicle is required prior to departure.

The security deposit can be paid by:

• banking footprint

• check

• cash

This security deposit will not be collected except in the following cases:

• damage to the vehicle

• traffic violations

• failure to comply with the terms of the contract

• exceptional cleaning or restoration costs

Article 6 – Vehicle Condition (Check-in/Check-out)

A vehicle inspection is conducted before departure (check-in).

A checkout inspection is conducted upon return.

The customer agrees to be present during these inspections.

If the guest is not present at check-out, the condition of the property as noted by MEHARIVIERA shall be deemed accurate.

Any damage discovered after the service has been provided may be billed to the customer.

Article 7 – Restrictions on Use

It is strictly prohibited to:

• drive on a highway or similar expressway

• remove, dismantle, or handle tarps or metal roof structures

smoking in vehicles

• to travel off public roads

• driving under the influence of alcohol, drugs, or medications that impair driving ability

• to lend or sublet the vehicle

Any violation will result in:

loss of coverage

full compensation for damages

Article 8 – Fuel and Reimbursement

Internal combustion engine vehicles are delivered with a full tank of unleaded 98 (SP98).

The vehicle must be returned with a full tank of SP98.

Otherwise, a fuel surcharge of €50 will be charged.

You may be asked to provide a fuel receipt at checkout.

Any mechanical issues resulting from the use of unsuitable fuel will be billed to the customer,

including

• any repairs

• towing fees

• the immobilization of the vehicle

• any operating losses

Article 9 – Children and Safety

These vehicles do not have ISOFIX anchors.

Consequently:

Car seats are not permitted

• Only booster seats without an ISOFIX system are permitted

The customer remains responsible for ensuring compliance and for installing the booster seat.Article 10 – Insurance and Deductible

The vehicles are covered by liability insurance.

The deductible is set at €1,000 per vehicle.

The customer is responsible for any damage in the following cases:

• at-fault accident

• negligence

• improper use of the vehicle

The driver is responsible for any traffic violations or infractions.

MEHARIVIERA may disclose the driver’s identity to the relevant authorities in accordance with applicable regulations.

Article 11 – Safety and Drivers’ Responsibilities

Before handing over the vehicles, MEHARIVIERA holds a safety briefing

including:

• driving instructions

• traffic safety rules

• the vehicle's specifications

Drivers agree to:

• Obey the traffic laws

• Obey speed limits

• Use the vehicle for its intended purpose

In the event of dangerous behavior or failure to follow instructions, MEHARIVIERA reserves the right to terminate

a non-refundable rental.

Article 12 – Seat Belts and Vehicle Regulations

Some of the internal-combustion vehicles in the MEHARIVIERA fleet are older models whose original design does not

does not require the installation of seat belts.

In accordance with the regulations applicable to vehicles of this category and age, the presence of seat belts

Safety is not mandatory.

The customer acknowledges that they have been informed of this technical feature and agrees to use the vehicle under these conditions.

In vehicles equipped with seat belts, wearing a seat belt is mandatory.

Article 13 – Liability

MEHARIVIERA is bound by an obligation of means.

MEHARIVIERA shall not be held liable in the event that:

• an accident caused by the driver

• failure to follow safety instructions

• dangerous behavior by a participant

Article 14 – Force Majeure

MEHARIVIERA shall not be held liable in the event of force majeure that prevents the performance of the service,

in particular in the event of

• exceptional weather conditions

• administrative decisions

• strikes

• unforeseeable events beyond itscontrolArticle 15 – Governing Law

These Terms and Conditions are governed by French law.

Any dispute arising from their interpretation or enforcement shall be subject to the jurisdiction of the courts of Nice.
